San Diego OKs $287,500 payout to 2 people injured on damaged road, sidewalk – San Diego Union-Tribune

San Diego taxpayers will spend almost $300,000 to pay a pair of claims filed by people who said they were seriously injured due to the city’s failure to properly maintain its infrastructure.

The City Council this week approved a $200,000 payment to Daniel McMahon, who was injured while riding a bicycle across uneven pavement in 4S Ranch. The panel also agreed to pay Rene Andrade $87,500 for injuries she suffered after tripping on a sidewalk in Scripps Ranch.

San Diego is self-insured, so the money will come from the public liability fund — a pot of revenue set aside in the city budget to pay damages derived from legal claims and lawsuits.

City officials did not immediately respond to questions about the cumulative amount of legal settlements and judgments paid by the public liability fund.

According to city budget records, the office in charge of managing claims is growing.

The 2024 fiscal year budget shows that spending by the risk management office rose by 20 percent in the past two years, from $12.3 million in 2022 to $15.4 million — money that does not include the actual claims and settlements.

Much of that new money is paying for extra help inside the office.

The city’s new budget added seven new positions, at a cost of $1.4 million — six full-time employees to help process claims and a new manager.

Two years ago, the office had 79 full-time workers; this year’s spending plan shows 94.

Reports to the City Council showed that McMahon was riding his bike in 4S Ranch on Sept. 18, 2021, when he ran across uneven pavement near a manhole cover along Camino Del Sur.

He fell and was injured, then sued the city the following year.

Andrade stumbled while walking along a buckled sidewalk east of Lake Miramar in Scripps Ranch nearly four years ago. She sued the city in 2021 for injuries she said were caused by the city’s negligence.
