Alleged Highland Park parade shooter Robert Crimo III won’t be a witness at his father’s upcoming trial for reckless conduct, but video of his police interview made in the hours after the shooting will be publicly shown for the first time, it was revealed at a Monday hearing.

At the Lake County Court hearing, Crimo III’s attorneys said their client, if called, would plead the Fifth Amendment in the bench trial of his father, Robert Crimo Jr. The father’s trial is scheduled to start Nov 6.

The father was charged in late 2022 with reckless conduct for vouching on state forms in 2019 that allowed his then-underage son to purchase firearms, authorities said. Prosecutors say that Crimo Jr. should have known that his son was troubled, making him a poor candidate for gun ownership.

Crimo III has been subpoenaed to testify in his father’s trial. However, his attorneys from the Lake County public defender’s office told Judge George Strickland that Crimo III would invoke his right to not potentially incriminate himself.

The judge said he would accept the attorneys’ representation, and not make Crimo III appear in court to invoke his Fifth Amendment right.

However, lawyers acknowledged that portions of the video of the police interrogation of Crimo III will be admitted into evidence in the case against the father and shown in court.

Authorities say Crimo III killed seven people and wounded dozens of others on July 4 2022, when he opened fire from a downtown Highland Park rooftop on spectators gathered to see the village’s Independence Day parade.

He escaped in the ensuing chaos, but was arrested that evening, officials said. Police questioned Crimo III for more than seven hours that night and into the early hours of July 5.

In another ruling Monday, the judge said he would allow testimony from a youth group leader who said Crimo III talked about school shootings at a meeting when Crimo was a high school freshman. The leader was concerned enough to call the father, who came to the meeting and attempted to “minimize” the boy’s comment, prosecutors said.

The youth leader will testify that Crimo III put a cap pistol against the leader’s neck and pulled the trigger, State’s Attorney Eric Rinehart told the judge.

Crimo Jr. ‘s lawyers asked the judge to bar the testimony. Rinehart argued that it was relevant.

“It’s an important interview to show the father is in absolute denial about the safety of other people,” he said.

Prosecutors said Monday they also plan to call Crimo III’s younger brother to testify about his Crimo III’s mental state.

The judge set a Friday hearing to resolve final pretrial issues.
